For the purposes of this section, “Synergy Catering” means Synergy Catering and each of our group or affiliated companies, licensors, partners, suppliers, employees, consultants and agents.
Synergy Catering disclaims any liability for the accuracy, content or completeness of the information on this website, or for the reliability, operability, security or availability of the website and/or the online ordering service function. Specifically, we disclaim any warranty of any kind, whether express or implied, that the website, the online ordering service function or the server that makes them available are free of viruses or other harmful components.
Whilst we shall use our best efforts to ensure that your order is correctly and satisfactorily fulfilled under the online ordering service, and we will deal with any discrepancies as set out in these Terms of Use, to the fullest extent permissible under applicable law Synergy Catering disclaims any warranty of any kind, whether express or implied, as to products sold by Synergy Catering, including without limitation the availability, merchantability or fitness for any particular purpose of any product or ingredient.
In no event shall Synergy Catering be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond its reasonable control including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, shortages of labour or materials, fires, floods, storms, explosions, acts of God or delays or non-performance by third parties.
No agent or representative of Synergy Catering is authorised to make any warranties, representations or statements regarding the products or the online ordering service and Synergy Catering shall not in any way be bound by any such unauthorised warranties, representations or statements.
To the extent permitted by law, Synergy Catering shall not be liable for any direct, indirect, special, incidental, or consequential damages (including damages for loss of revenue, profits or data) arising in contract, tort or otherwise (including negligence) out of any use of, or inability to use, this website (including the online payment system).
Specifically relating to the online payment system, to the extent permitted by law, Synergy Catering will not be liable for any loss or damage (including indirect and consequential loss) suffered by you by reason of (i) any failure, delay, interruption, suspension or any other restriction affecting your Online Payment; (ii) any errors, malfunctions or breakdown of your bank’s payment mechanism; or (iii) any other matter arising out of, or in connection with, the online payment system.
In any event Synergy Catering shall not be liable to you for any amount exceeding either the price of the products ordered under the online ordering service which are the subject matter of any liability or, in the absence of such an order, HK$1,000.
